MISTRIAL FOR WATADA!!!!!!!!!!!!!!!!!!!!!!!

While I am elated for the fact that First Lt. Ehren Watada will probably not go to jail for his opposition to the Iraq War, I am disappointed that the questions that were being asked (is this an illegal and immoral war?) will not be answered...............Here is the latest batch of articles on Watada........... Bill Simpich writes: "First Lt. Ehren Watada knew exactly what his case was
about - and that scared the judge. There was absolutely no reason to stop the
Watada trial."

On Day 2 of the court-martial proceeding against First Lt. Ehren Watada, the
prosecution presented three witnesses. Many observers, including Truthout's
legal analyst Bill Simpich, believed the witnesses helped the defense as much as
the prosecution. Defense attorney Eric Seitz is optimistic going into Day 3 as
Watada is scheduled to take the stand.

The opposition of Watada and his defense team to the mistrial, declared by the
military judge and eventually endorsed by prosecutors after their case fell
apart, opens the door for a double-jeopardy defense. Double jeopardy, which
forbids a person from being tried twice for the same crime, does not apply only
after a verdict is rendered, but can apply after a jury is empaneled and
witnesses have been called.
